Sample Flexible Work Agreement

Instructions: This document contains the major considerations that an employee and her/his manager should take into consideration when an employee begins to work a flexible work arrangement.

Agreement is between _______________________________

and  _______________________________

at  ________________________________________________

Type of Agreement

  • Compressed work week, e.g. working four ten-hour days;
  • Remote work, e.g. working in a location different than the main office;
  • Flex-time, e.g. starting and/or ending before or after "normal work hours";
  • Job sharing, e.g. sharing the responsibilities of a full time employee between two (or more) employees; and/or
  • Other

Benefit to Employee & Company

  • Detail the benefits this flexible work arrangement will offer the employee and the company.

Office Hours & Availability

  • The agreement should outline the days and hours when the employee will be working in the office

  • If applicable, the agreement should outline the days and hours when the employee will be available at a remote work location

  • If applicable, the agreement should outline how calls to the employee's desk will be transferred, e.g. to her/his cell phone

  • The agreement should outline an expectation of response times, e.g. client and teammates' calls or emails will be returned within one hour/two hours/four hours

Office Environment

If the employee is working from home or another space that is not owned/leased by the employer, this section would outline the expectations for this remote environment. Examples of this include

  • It will be quiet
  • It will be furnished with work tools, e.g. desk, task chair, computer, printer, fax line, etc.
  • It will have communication tools including, e.g. high speed internet connection, VPN capabilities, fax and dedicated LAND line, etc.

Who will incur the expense of furnishing the remote work space? In some cases, employers pay for standard equipment.

Good Faith

(Optional) The employee and manager agree that they will act in good faith, keeping each other apprised of how well the agreement is working, alerting the other to issues that may interfere with the successful completing of projects, etc.
